Article 29, Electronic Communication Code: “Art. 29 Procedure to limit the number of rights of use to be granted for radio frequencies 1. When considering whether to limit the number of rights of use to be granted for radio frequencies, the Authority: a) takes adequate account of the need to optimize the benefits for users and to encourage the development of competition and the sustainability of investments with respect to market needs, also in application of the principle of effective and efficient use of the radio spectrum referred to in articles 14, paragraph 1, and 27, paragraph 6; b) grant all interested parties, including users and consumers, the opportunity to express their position, in accordance with Article 11; c) publish any decision relating to the granting of a limited number of individual rights of use, stating the reasons; d) establish procedures based on objective, transparent, proportionate and nondiscriminatory selection criteria; e) reviews these limitations at reasonable deadlines or at the reasonable request of the operators concerned. 7. In the case of competitive or comparative selection procedures of particular national importance, the Authority may submit to the Minister of Communications the proposal, to be sent to the Presidency of the Council of Ministers, for the establishment of a Committee of Ministers in charge of coordinating the procedure itself. , in particular as regards the announcement and the tender regulations.”

The number of rights of use to be granted for radio frequencies may be limited only when this is necessary to ensure the efficient use of the frequencies in accordance with Article 29 and Article 14, paragraph 1. Law on Electronic Communications Article 104: Limiting number of approvals for use of radio-frequencies Under the Radio-Frequency Assignment Plan from a particular band, the Agency may introduce the limitations in the number of approvals for use of radio-frequencies for particular types of radiocommunications networks or wireless access technologies, on the principle of proportionality and on equal terms, for the purpose of: - avoiding harmful interference; - protection of environment and human health against the effects of electromagnetic radiation; - achieving maximum benefits for users and promoting competition; - ensuring service quality; - providing efficient use of radio-frequency spectrum; - achieving the objectives in public interest.
