Section 32I, Telcom Ordinance: “32I Spectrum utilization fee (1)Subject to the consultation requirement under section 32G(2), the Authority may by order designate the frequency bands in which the use of spectrum is subject to the payment of spectrum utilization fee by the users of the spectrum. (2)The Secretary may by regulation prescribe— (a)the level of spectrum utilization fees; or (b)the method for determining the spectrum utilization fees, which may be by— (i)auction or tender or a combination of auction and tender; or (ii)such method as the Secretary thinks fit, including any method combined with a method mentioned in subparagraph (i). (Replaced 12 of 2001 s. 4) (3)A spectrum utilization fee may be calculated on the basis of a royalty or any other basis that includes an element in excess of the simple recovery of the cost of providing a service by the Authority…”

Section 13E: Renewal of licence (1) Not less than 15 months before the date for any renewal of a licence under section 13D(1)(b) or such shorter period as the Governor in Council may permit, the Authority shall submit recommendations to the Governor in Council concerning the renewal of the licence and the terms and conditions to be imposed. (Amended 17 of 2011 s. 28) (2) Having considered the recommendations submitted under subsection (1), the Governor in Council may— (a) renew the licence subject to such terms and conditions as he may specify; or (b) renew the licence by granting a new licence in substitution therefor, and in doing so, may impose such terms and conditions as he may specify; or (c) refuse to renew the licence. (3) Notice of a decision to refuse to renew a licence shall be given to the licensee concerned at least 12 months prior to the relevant date for renewal of the licence. (4) Where it is necessary for the due compliance with this section the Governor in Council may extend the term of any licence.

- DN có thể bị hủy bỏ, thu hồi hoặc đình chỉ GP trong thời hạn không quá 12 tháng khi DN vi phạm quy định của Pháp lệnh này, của giấy phép.

- DN không được hoàn trả bất kỳ khoản phí nào hay khoản tiền nào đã nộp bao gồm phí sử dụng tần số đã trả (bản chất là tiền đấu giá).

Tại HSMĐG: CQQL có thể hủy bỏ, thu hồi hoặc đình chỉ giấy phép trong thời hạn không quá 12 tháng khi DN vi phạm giấy phép, quy định của Pháp lệnh Viễn thông hoặc bất kỳ các điều kiện nào mà DN bị áp dụng. Khi đó DN có cơ hộ được giải trình.

TELECOMMUNICATIONS ORDIANCE

34. General provisions as to licences, etc.

(4) Any licence, permit, permission or consent granted under this Ordinance may at any time be cancelled or withdrawn by the authority by whom it was granted, or suspended by such authority for such period, not exceeding 12 months, as the authority specifies, in the event of any contravention by the licensee or the person to whom the permit, permission or consent was granted, as the case may be, of this Ordinance or of any condition to which the licence, permit, permission or consent is subject, and any such licence may be cancelled or suspended at any time by the Governor in Council if he considers that the public interest so requires.

(5) Where any licence, permit, permission or consent granted under this Ordinance is cancelled, withdrawn or suspended, no part of any fee or other sum paid in respect thereof or thereunder shall be refunded, including any spectrum utilization fee paid pursuant to section 32I. (Amended 12 of 2001 s. 5)

32I. Spectrum utilization fee

(1) Subject to the consultation requirement under section 32G(2), the Authority may by order designate the frequency bands in which the use of spectrum is subject to the payment of spectrum utilization fee by the users of the spectrum.

(2) The Secretary may by regulation prescribe—

(a) the level of spectrum utilization fees; or

(b) the method for determining the spectrum utilization fees, which may be by—

(i) auction or tender or a combination of auction and tender; or

(ii) such method as the Secretary thinks fit, including any method combined with a method mentioned in subparagraph (i). (Replaced 12 of 2001 s. 4)

C.13 Revocation of the Licence

C.13.1 Under section 34(4) of the TO, the Authority may cancel or withdraw the Licence, or suspend the Licence for a period not exceeding 12 months, in the event of any contravention of the Licence, the TO, or any condition to which the Licensee is subject. In exercising such a power, the Authority will give the Licensee a reasonable opportunity to make representations. The exercise of this power must be proportionate and reasonable in relation to the contravention concerned.

C.13.2 The Chief Executive in Council may, under section 34(4) of the TO, cancel or suspend the Licence at any time if he considers that the public interest so requires.
