Telecommunications Act (Chapter 323, Section 74) Telecommunications (Radiocommunication) Regulations (Rev Feb. 2022) Exclusion from allocation of spectrum rights 9.—(1) The Authority may, by notice in writing, exclude any person from participating or limit any person’s participation in the allocation of any spectrum right — (a) for the purpose of developing the communications industry in Singapore and maintaining effective competition between person engaged in the provision of radio-communication services; or (b) in the public interest. (2) Before excluding any person from participating, or limiting any person’s participation, in the allocation of any spectrum right, the Authority shall give the affected person an opportunity to be heard. (3) Any person aggrieved by the Authority’s decision under this regulation to exclude any person from obtaining, or limit any person’s right to obtain, any spectrum right may appeal to the Minister whose decision shall be final.

PART VII PROVISIONS APPLICABLE TO STATION (SPECTRUM) LICENCES, NETWORK (SPECTRUM) LICENCES, STATION LICENCES AND NETWORK LICENCES
(1) Except with the approval in writing of the Authority, a licensee shall not —
(a) assign, transfer, sublet or otherwise dispose of the benefit of any station (spectrum) licence, network (spectrum) licence, station licence or network licence granted under these Regulations; or
(b) permit another person to participate in any of the benefits, powers or authority granted under such licence.
(2) It is a condition of every station (spectrum) licence, network (spectrum) licence, station licence and network licence that every station and network under the licence must be under the control of the licensee unless the Authority otherwise permits in writing.

8. Suspension or cancellation of licence, etc..
(1) If the Authority is satisfied that a person who is granted a licence under section 5 or 5B or any regulations made under this Act is contravening, or has contravened, whether by act or omission —
(a) any of the conditions of the licence or part thereof;
(b) any provision of any code of practice or standard of performance;
(c) any direction of the Authority given under section 27, 32D(2)(a), (b) or ( c), 32DA(2)(d)(ii) or 32F(2); or
(d) section 32B or any terms or conditions of participation in a dispute resolution scheme (within the meaning of section 32N(2)),
the Authority may, by notice in writing, do either or both of the following:
(i) issue such written order to the person as it considers requisite for the purpose of securing compliance thereof;
(ii) require the person to pay, within a specified period, a financial penalty of an amount not exceeding the higher of the following amounts:
(A) 10% of th eannual turnover of that part of the person’s business in respect of which the person is granted the licence, as ascertained from the person’s latest audited accounts; or
(B) $1 million
(2) If the Authority is satisfied that —
(a) the person mentioned in subsection (1) is again likely to contravene, whether by act or omission, any condition, provision,direction or section referred to in that subsection;
(b) the person mentioned in subsection (1) has gone into liquidation other than for the purpose of amalgamation or reconstruction;
(c) the person mentioned in subsection (1) is no longer in a position to comply with this Act or the terms or conditions of his licence; or
(d) the public interest so requires,
the Authority may (in lieu of an order or a financial penalty under subsection (1)(i) or (ii)) by notice in writing and without payment of any compensation or refund of any fee, do all or any of the following:
(i) cancel the licence or part thereof;
(ii) suspend the licence or part thereof for such period as it thinks fit;
(iii) reduce the period for which the licence is to be in force.

13.4 By participating in the New Entrant Spectrum Auction and/or the General Spectrum Auction, a Winning Bidder is deemed to have been notified of, have acceded to and have agreed to comply with, the specific conditions to be included in the FBO Licence, including the Schedule in relation to the provision of 4G and/or IMT-Advanced telecommunication systems and services pursuant to the grant of a 700 MHz Spectrum Rights (2016), 900 MHz Spectrum Rights (2016), 2.3 GHz Spectrum Rights (2016) and/or 2.5 GHz Spectrum Rights (2016) set out in Appendix 1 of the Information Memorandum. This shall include, among other things, the requirement to comply with the following timelines for the rollout of 4G and/or IMT-Advanced telecommunication systems and services:…
14.1 There is no commitment by IDA that the duration of the 700 MHz Spectrum Rights (2016), 900 MHz Spectrum Rights (2016), 2.3 GHz Spectrum Rights (2016) and/or 2.5 GHz Spectrum Rights (2016) allocated under this Allocation Process will be extended for any period, if at all.
