Article 85 (trang 104), LAW N°24/2016 OF 18/06/2016 GOVERNING INFORMATION AND COMMUNICATION TECHNOLOGIES (2016) “Section 4: Networks, services and scarce resources Article 85: Procedures for allocation of rights to radio spectrum The procedure for allocating rights to radio spectrum as well as the conditions for participation in the allocation of rights to radio spectrum and the charges payable for spectrum rights are determined by the Regulatory Authority. One or joint procedure to use in allocating rights to radio spectrum are as follows: 1° auction; 2° public offer; 3° allocation for a pre-determined fee or a negotiated fee. For the purpose of promoting the competition of providing communication service to people, the regulation authority may refuse to grant or reduce the right to compete for rights to radio spectrum. Such refusal or reduction is notified by writing and the applicant is given the opportunity to give his/her opinion.”

Article 56: Renewal of license Three (3) months before the expiry of the existing license, the license holder may apply to the Regulatory Authority for renewal of a license and the procedure for the renewal of license is the same as that applicable to the granting of the original license. Electronic communications networks or service provider who fails to request for the renewal of his/her license or whose application for renewal is rejected by the Regulatory Authority ceases to have any legal authority to continue to operate or install the electronic communications networks or services.

Information and connmunication technologies Law Article 86: Limitation on radio spectrum use For purposes of ensuring the efficient use of radio spectrum, the Regulatory Authority has the power to impose limitations on the use of particular frequencies for bringing efficiency in the use of frequencies and the services provided by the licensees.
